BJP Legal & Legislative Cell State Convenor Onkar Seth has ridiculed the statement of the former Chief Minister Omar Abdullah that the Accession of Jammu and Kashmir with Indian Union was conditional. He alleged that the NC leader was flouting the provisions of the state and Indian Constitution, under which Omar himself and his father Dr. Farooq Abdullah are under oath which they have taken not only once but many a times.
Onkar Seth pointed out that in both the constitutions, the State of Jammu & Kashmir is an irrevocable part of India and these provisions cannot be amended.
“Omar should know that what wrong he is committing and what are the implications of it”, Seth observed and further pointed out that many legal luminaries, including two former Chief Justices of the Apex Court viz Dr. A.S. Anand and Mehar Chand Mahajan, had also made it clear in their observations.
He recalled that Maharaja Hari Singh had signed the same Instrument of Accession which was signed by over 560 Princely states of India. This was under the law pertaining to the Independence Act of India. If anybody had put any condition beyond that law, it had no legal sanctity, he cleared and reminded the leaders like Omar Abdullah to honour the constitution when enjoying power or out of power.
